Family Law Section: How Mortgages Surrounding Divorces are Different

Divorce situations present unique obstacles for home financing. Whether divorcing couples want to remove a name from a current loan, pull out equity to pay a marital settlement or the exiting spouse wants to purchase a new home, most clients get led down the wrong path by Loan Officers who aren’t as knowledgeable in divorce scenarios. We will discuss what verbiage needs to be written into the divorce decree for certain scenarios to help the client in the mortgage underwriting process including how the decree enables the client to purchase a new house without having to remove their name from the old mortgage. We will also discuss how and when spousal maintenance and/or child support can be used as income in qualifying for a mortgage as well as how temporary support can be critical to the timeframe. Finally, we will discuss using a Qualifying Name Delete Assumption as a potential tool to remove a name from an existing mortgage without having to refinance.
