Although in 2013 the Minnesota legislature gave same-sex partners the right to marry, and although in 2015 the U.S. Supreme Court in Obergefell gave same-sex people the right to marry, many people are surprised to learn that in Minnesota, same-sex parents still do not have access to the same basic fundamental rights that heterosexual couples enjoy. Many people referred to Minn. Stat. § 517.01 as our ‘marriage equality’ statute and believed that Minnesota had put an end to all sex-based distinctions in marriage by choosing to provide for the domestic rights of same-sex couples. Unfortunately, in practice, the door to the courtroom is closed to same-sex parents seeking to establish their rights following the breakup of the relationship with their partner.
